Terms & Conditions

Welcome to Healthy Roots Tennessee. By using this website, requesting an estimate, submitting a contact form, or engaging Healthy Roots Tennessee for services, you agree to the following terms and conditions.

1. Services

Healthy Roots Tennessee provides commercial landscape maintenance, landscape enhancements, turf care and renovation, landscape installation, irrigation services, drainage solutions, seasonal services, and related landscape management services.

Services offered may vary by property, location, season, licensing requirements, and availability.

2. Estimates & Proposals

Estimates and proposals are based on the information and property conditions available at the time they are prepared.

Pricing may be subject to change if site conditions, quantities, measurements, material costs, labor requirements, access conditions, or the requested scope of work differ from what was originally represented.

Only services specifically identified in an approved proposal, estimate, or service agreement are included.

3. Commercial Maintenance Agreements

Recurring commercial landscape maintenance services are governed by the individual Landscape Maintenance Agreement executed between Healthy Roots Tennessee and the client.

If these website Terms & Conditions conflict with a signed agreement, the signed agreement will control.

4. Additional Work & Enhancements

Services outside the contracted scope are considered additional work.

Healthy Roots may identify and recommend plant replacements, turf renovations, irrigation repairs, drainage improvements, landscape enhancements, or other corrective work during routine property visits.

Recommendations do not authorize Healthy Roots to perform the work. Additional work requires client or authorized property management approval unless another authorization process has been established in writing.

5. Scheduling

Service schedules may be affected by weather, saturated soil, extreme temperatures, holidays, equipment issues, property access, safety concerns, or other circumstances outside our reasonable control.

Healthy Roots reserves the right to modify service dates when performing the scheduled work could damage the landscape, property, or equipment or create unsafe working conditions.

6. Cancellations

Cancellation requirements for recurring commercial services are governed by the applicable service agreement.

Approved enhancement or project work that is canceled may be subject to charges for materials, equipment rentals, mobilization, subcontractors, restocking fees, or other costs already incurred or committed.

7. Payment

Payment terms will be stated on the applicable proposal, contract, or invoice.

Invoices must be paid according to those terms. Healthy Roots reserves the right to suspend services on past-due accounts subject to the terms of the applicable agreement and applicable law.

8. Property Access

Clients are responsible for providing reasonable and safe access to areas where services are scheduled.

This includes providing necessary gate codes, access instructions, parking information, security procedures, and other information required to perform the work.

9. Underground & Concealed Conditions

Clients are responsible for informing Healthy Roots of known private utilities, irrigation components, drainage systems, invisible fencing, landscape lighting, electrical systems, privately installed lines, or other concealed property features that may not be identified through standard utility locating procedures.

Healthy Roots is not responsible for damage resulting from undisclosed, improperly installed, or unmarked private systems except to the extent caused by Healthy Roots' negligence or as otherwise required by law.

10. Landscape Conditions

Plants and turf are living materials affected by weather, temperature, soil conditions, irrigation, drainage, pests, disease, wildlife, maintenance practices, and other environmental factors.

Healthy Roots cannot guarantee the continued health or survival of turf or plant material unless a specific written warranty is provided with the applicable service or installation.

11. Irrigation

Healthy Roots may identify irrigation concerns while evaluating or maintaining a property.

Unless irrigation management is specifically included in the contracted scope, the property owner or management company remains responsible for ensuring adequate watering of turf and plant material.

12. Safety

Healthy Roots reserves the right to postpone, modify, or discontinue work when conditions create an unreasonable risk to employees, subcontractors, residents, tenants, visitors, equipment, or property.

Clients should notify Healthy Roots of known hazards or special property conditions before work begins.

13. Property Observations & Recommendations

As part of our landscape management approach, Healthy Roots may provide observations and recommendations concerning turf, plants, irrigation, drainage, landscape appearance, or other visible property conditions.

These observations are intended to assist property management and do not constitute engineering, structural, environmental, arboricultural, or other specialized professional assessments unless specifically stated.

14. Photos & Documentation

Healthy Roots may photograph landscape areas for estimating, documentation, quality control, service reporting, training, and internal recordkeeping.

Photos containing identifiable residents, tenants, confidential information, or other sensitive content will not intentionally be used for public marketing without appropriate authorization.

15. Website Information

Healthy Roots makes reasonable efforts to keep information on this website accurate and current. However, website content is provided for general informational purposes and does not constitute a binding proposal, guarantee, or service agreement.

Pricing, service availability, specifications, and other information may change without notice.

16. Intellectual Property

The Healthy Roots Tennessee name, logo, branding, graphics, photographs owned by Healthy Roots, and original website content may not be copied, reproduced, distributed, or used for commercial purposes without written permission.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Healthy Roots Tennessee will not be responsible for indirect, incidental, special, or consequential damages arising from use of this website or services provided.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

18. Third-Party Services

Certain projects may involve suppliers, subcontractors, equipment rental companies, utility locating services, payment processors, or other third parties. Healthy Roots is not responsible for the independent acts or omissions of third parties except where responsibility is imposed by applicable law or contractual agreement.

19. Governing Law

These Terms & Conditions are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

20. Changes to These Terms

Healthy Roots Tennessee may update these Terms & Conditions periodically. Changes become effective when the revised Terms & Conditions are posted to this website with an updated revision date.
